Terms of Service

These Terms of Service (“Terms”) govern your use of the website thisplaceisours.com and the private community applications operated by This Place Is Ours (“TPO,” “we,” “us”), including Project Freefall (together, the “Services”). By creating an account or using the Services, you agree to these Terms.

1. Membership

• Our communities are private and invite-only. Account creation requires an invitation (such as a community key) issued by a community owner or administrator.
• You must provide accurate account information and keep your credentials secure. You are responsible for activity on your account.
• You must be at least 18 years old to use the Services. Our communities are intended for adult creative professionals.
• Community owners and administrators may set additional guidelines for their community and may suspend or remove members who violate them.

2. Your content

• You retain ownership of the content you create and share in the Services (posts, photos, projects, messages, and other material).
• You grant us a limited license to host, store, and display your content solely to operate the Services — for example, showing your posts to fellow members of your community.
• You are responsible for the content you share and must have the rights to share it.

3. Community conduct

The Services are built on trust. You agree not to:

• Harass, threaten, or abuse other members;
• Post content that is unlawful, hateful, pornographic, or infringes the rights of others;
• Impersonate any person, misrepresent your affiliation, or share invitation keys with people outside your community without permission;
• Attempt to probe, disrupt, or gain unauthorized access to the Services or other members’ accounts;
• Use the Services to send spam or unsolicited commercial messages.

Members can report content and block other members in the app. We and community administrators may remove content or restrict accounts that violate these Terms or community guidelines.

4. Beta software

Some of our apps are distributed as pre-release (beta) software, for example through Apple’s TestFlight. Beta software may contain bugs and may change or be discontinued at any time. Your use of TestFlight is also subject to Apple’s terms.

5. Termination

You may stop using the Services and delete your account at any time in the app (Profile → Account) or by contacting us. We may suspend or terminate accounts that violate these Terms. Sections that by their nature should survive termination (such as content licenses needed to wind down the account, disclaimers, and limitations of liability) survive.

6. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or secure.

7. Limitation of liability

To the maximum extent permitted by law, TPO will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the past twelve months and one hundred US dollars.

8. Changes

We may update these Terms from time to time. If we make material changes, we will update the effective date above and notify members in the app or by email before the changes take effect. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

9. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules.
